and are namely

- Pune Condo Hotel.
- Hospital Rooms & Parking slots.
- Dubai Condo Hotel Resales.
- Land
& Property purchases & JV deals, and
Partnerships.
TERMS
AND CONDITIONS
Object
of the Contract: Sale of the Developer’s Real Estates,
and other services by
the agent, without there existing a labor relation of
any type between the both parties.
Commissions:
On
Sale of Developers listed Properties: The developer offers 6% commission (18%
instead of 6% commission during the first 6 months)
on all sale payments sent by the Agent. Self sales to
Agent himself is allowed after he has made one similar
unit sale to a third party . For sending & forwarding inquiries of interested buyers
& Hot leads, when the developer representatives have
to contact and correspond with the buyers to close the
sale, or help the Agent close the sale, then the
commission is 3% only.
On
subsequent sales to existing clients introduced by the
agent, the commission will be 3%.
Payments:
The commissions are paid to the agents/sales Rep
within 15 days of receipt of funds from the buyers.

and Property and Land purchases or JV deals. check

then the commission is 3% of the cash
exchanged. On
sale of the Partnership percentage, EWD receives money
from the joining partners.
On Purchase and JV deals, EWD pays the money to the
Landowners. For JV deals, the Agent will also
receive 3% of the funds received by EWD from the
operational income from the running of the JV development. Payable on the date the
Cash/check is either received or paid by the EWD.
All Commissions are
paid on the actual amount of funds received or paid by the
developer, EWD. All commissions
become due and are payable on the date
of the transaction, that is when the
Cash/check/payment is exchanged, that is either it is
paid or received by the developer.
When 2 or more Agents are working on
the same deal, then the commissions will be split.
Reporting: The developer undertakes to keep the Agent in the email
correspondence loop, or to report to the Agent the
progress of each lead supplied on a monthly basis.
Commissions
adjustment in case of Cancellations
& Refunds: We do not accept cancellations from the Buyers after the sale is
done. If a buyer is desperate for cancellation,
and if the sale is thru an Agent. We will ask the Buyer
to forward his cancellation request thru the Agent. If
the Agent disapproves the cancellation, then the Agent
needs to satisfy the Buyer in that regard. EWD will also
support the Agent's decision. However, if the
cancellation is approved on strong refund grounds by the
agent and then also by the EWD, and EWD has to refund
the buyers money then the commissions paid to the Agent
are also cancelled, and the Agent will refund back
to
the EWD any commissions received in that respect.
It is projected that such refunds and
cancellations are likely to be less than 2-3%.
Promotion:
For promoting and selling the developer properties, the
Agents will have to do so at its own costs, and
will need to find his customer base himself. All
the info is on the site. The best would be to copy
and paste or print the key pages, study all the
info, get any clarifications if needed and then start
and promote to his friends, customers, and
client base or on his web site.
Duration of the contract:
The present contract will be effective
from the date of signature to this agreement and shall
have duration of 2 years and is renewable after 2 years, save where the parties to the contract agree to
terminate the same with mutual consent. However any party can cancel and
terminate this agreement anytime by giving a
3-day’s notice to the other party.
Termination: The
Agent will not receive any commission on any funds received
from clients and existing customers after the termination or expiry of this
Agreement. The Agent will only get commission on funds
received from customers before the termination or expiry
date. The Agent however, will retain and keep all commissions
already paid to him till that date.
Confidentiality: The
terms of this agreement, and the details of the
properties offered are confidential between the
parties and neither of the contracting parties may
divulge the contents without consent in writing to any
other party.
Both parties agree to be bound by all the above terms and
conditions on the date.
