drawings, location, construction period, completion dates, architect plans,area sizes,
site & floor plans, prices and availability etc are
approximate indications and information is subject to
change without notice. The Seller reserves the right to
make revisions. Buyer when making a reservation, agrees to
accept these revisions.
The Buyer has read, understood and accept all the terms of the Disclaimers, including Disclaimers on the projected earning potential.
YOU ARE REQUESTED TO DO YOUR OWN DUE DILIGENCE, AND CONSULT YOUR OWN TAX AND FINANCIAL ADVISORS BEFORE MAKING A RESERVATION.
The Developer reserves the right to accept or reject any application received.
All Bank & transaction charges are borne by the
Buyer, unless where mentioned otherwise.
Duration of the construction of the development is estimated at
24 months from
commencement of work on site and is subject to force majeure conditions.
All materials, dimensions & drawings are approximate and information is subject to change without
notice. The Seller reserves the right to make revisions.
The Buyer will be subject to and comply with all the requirements of the
Property location Land Registration Rules.
All disputes arising in relation to this Reservation shall be restricted and subject to the jurisdiction of the courts in
the city of the property location in India only.
East West Developments may modify these Terms of Use, at any time, simply by updating this posting and without notice to you.
Due Diligence
The property offered for sale by The Company is offered and marketed to you The Purchaser in
the form of our Property Release document and contains the information gained by The Company
under its due diligence program of property vetting. The information contained in the Property
Release document is, to the best of The Company's knowledge, correct and true and shall contain
no statement which The Company knowingly knows to be false, misleading, or otherwise incorrect.
However, the information contained within the Property Release Document will have been
compiled, in full or in part, as a result of enquiries made within the territory to establish the factual
information put forward as a proposal to purchase. as this information often has to be gleaned
from Third Parties, The Company cannot accept any liability for any false, inaccurate, or otherwise
incorrect information contained within the Property Release Document, where such information
has had to be gleaned from such Third Parties.
Pre Reservation Form
It is a condition of sale, that the Purchaser shall ,and be required to, without exception, complete,
sign, and deliver to The Company, a fully completed Pre Reservation form for the
property that they wish to purchase. No Registration is valid or effective unless and until accompanied by a fully refundable Registration deposit in the amount of
$10.
Late Payment
The Company reserves the right to apply late payment penalties. All payments shall be first applied to interest and the balance to principal. In the event of payment default, the entire unpaid balance shall, at the option of the Lender, become immediately due and payable. The Borrower will remain fully bound until full payment is made. In the event of default, the Borrower agrees to pay all reasonable solicitors fees and costs of collection.
Refund of Fees.
A refund of the Buyer's Registration deposit
of $10 per each unit may be made at any time upto 1 year from the reservation date by written request to the Developer.
In such case, Buyer's deposit will be refunded within 7 days to the same credit card as was used originally to make the deposit. Registration deposits made by credit card are subject to a non-refundable additional charge for administration and handling / processing of the transaction. Buyer accepts the administration and handling charge
If we charge you a fee for the reservation of a property, then there shall be no refund of fees
owed if the purchase is unable to proceed with the purchase of the property for any reasons beyond
the normal reasonable control of the Company, it is the responsibility of the Purchaser to
ensure that they are financially in a position to proceed with the purchase of a property through
to completion before pre reservation of that property.
Change of Property.
On rare occasions, due to circumstances beyond our control, it may no longer be possible
to continue to purchase a property reserved through the company. On such occasions,
The Company reserves the right to substitute the original property offered for sale
and subsequently reserved to an alternative property and on occasions, in an alternative
hotel. If this occurs, then the substitute property offered shall offer the same or better
terms of engagement, in thee opinion of the company, than that which was originally
offered for sale to the client. The purchaser agrees to be guided by thee expert opinion
of the company in this regard and shall accept and continue to purchase any substitute
property offered to the purchaser in this regard, or can ask for a full refund.
