Our plan is to have only  one exclusive Customer Support Center for each Country for our properties in that country, unless the number of properties and volume of business justifies splitting that country in different States. Easch Support center will have certain propereties under their jurisdiction.  100% of our clients for properties in your country, are expected to contact you, the local Customer Support Center in that Country, either before or after their purchase.  You get a commission on all that. Regardless if the Sales are done by you or us.  However in the beginning, during our search for a suitable Customer Support Center, that can give satisfactory service to our Clients, we may initially appoint more than one Customer Support Center in a Country, and then trim it down to the exclusive Agent Center that  gives the best service. You may have to split your commissions with others, during this trial search.

Developer expects the Supoort Center to do the Property presentation, every Friday for Properties under their jurisdiction.  Properties under the jurisdiction of this Support Center will be mentioned in the Developers approval confirmation email.

TERMS AND CONDITIONS.  IT IS AGREED AS FOLLOWS:

WHERE AS:  East West Developments is a real estate developer and marketing company with offices, representatives and properties around the World, and is marketing real estates worldwide through real estate agents, Customer Support Centers and private individuals.

The Agent/Customer Support Center is an independent company and has its own Bank account and financials and its own profit & loss., The object of the agent/Customer Support Center is that it will provide Customer Support services on behalf of the USA company, and for other developers and builders, for a fee or commissions.  Customer Support Center is not  responsible for the profit or loss of the USA company. The agent/Customer Support Center profits only from the commissions he receives for giving his services for operating the Customer Support Center.

EWD has many opportunities; And can help the Customer Support Center in many fields. As our registered Customer Support Center , the Center can have multi streams of income. As defined  below in #1, #2, #3, #4, #5, #6 and #7 :

The properties available for marketing and Customer Support Services are posted on the developer's website www.eastwestdevelopments.com, and are namely:

  1. Sale of Developers own properties.    EWD has many developments around the World. And each development has 300 or more units.   So for the Agent there are many opportunities of doing multiple sales.   Check link www.eastwestdevelopments.com/hotpropertyalerts.html  
  2. Resales and sales of third developer party properties.  Choice of many other properties on sale. Check link: http://www.eastwestdevelopments.com/home.html 
  3. Land & Property purchases & JV deals.  These are big deals. And big commissions can be made.  Check link http://www.eastwestdevelopments.com/purchase.html

  6. Possibility of additional streams of income:   Commission to be decided as per the services.                                 1.  Extra commission for searching or suggesting suitable land/lots for our future projects.                                          2.  Extra commission or fees for suggesting or supervising the contractors/builders, and construction for our projects.                                                                                                                                                                            3.   All our overseas property buyers are investors. They are all high net worth individuals. And by buying an Investment property in your country, they are just entering the local Property market of your country .  Sooner or later, they will probably buy more properties and will need other property services in your country.  Since we have these big development projects on our hands, and you being local. We will probably have an understanding with you of mutual benefit, and let you work on this additional business.

Commissions: EWD will pay, as per the Commissions structure above on all sales and support provided by the Agent EWD pays to Agents on new sales, 10% commission only on the actual money that is received or paid by the EWD. EWD receives money-in on Property sales and on sales of EWD Partnerships. And EWD pays money-out on Property or land purchases or JV deals with landowners. For all the above commissions when 2 or more Agents are working on the same deal, then the commissions will be split. This is a commissions only agreement. No other expenses are paid.  The Agent/Customer Support Center is not entitled to any other  remunerations, advance payments or reimbursements of expenses, if any incurred by the Agent/Customer Support Center for performing his functions under this Agreement.  Double commission is not valid. You either get the Customer Support Center Commission or the Agent commission, which ever is higher.

Benefits of being a Customer Support Center:   We will send you all our customers and Investors. And on providing your after sale services to these customers sent to you, you receive a commission. Regardless if the sales are done by you or us. Commission is paid on the actual amount of funds received by EWD for our properties in your Country.   Customer Support Center has all the benefits of an Agent, plus have propereties under their exclusive jurisdiction.

7.  After Sales Services on properties under the Support Center jurisdiction:   EWD pays 2% (Two percent) commission: When we send to you or introduce you to our old customers, who have already invested with us. And when they come to you, and you provide them  support, the Commission paid to you is 2% of what he has already paid us.  We have network of agents all over the world, who get a commission from us on bringing sales. However when you provide After Sale Support service to these clients, you still get your 2% commissions.    If the Agent/Customer Support Center has already received a commission on the sale as mentioned above. Then this 2% after sale commission is not applicable. Double commission is not valid. You either get the Sales Commission or the After Sales commission, which ever is higher.  After sale service commissions are payable within 15 days, when the service is provided. On all additional new sales to these existing customers by the Agent/Customer Support Center, commissions paid is 10%.  100% of our clients for properties in your country, are expected to contact you, the local Customer Support Center in that Country, either before or after their purchase.  For providing them service you get a commission on all that.  Regardless if the Sales are done by you or us. After Sales Services commissions are applicable only on EWD properties in your country and jurisdiction. Sales on each Condohotel Prorerty are expected at $100 millions. After sales commission earnings at 2% of over US$ Two millions  are achievable.  EWD can also teach the Support Center to easily bring in good results.

All commissions become due and applicable when the Cash/check/payment is exchanged, that is either it is paid or received by the EWD.    All Commissions are paid on the  actual amount, that is the actual Money that is received or paid  by the developer, EWD on that date.  And all commissions become payable within 15 days of the payment date.

Object of the Contract: Sale of the Developer�s Real Estates, and other services by the agent/Customer Support Center, without there existing a labor relation of any type between the both parties.  You will be listed as our Customer Support Center on our website. All Customer inquiries may be issued and handled under the Support Center name, and Investors will be encouraged to contact you. Gradually our goal is that all correspondence and client inquiries work is done by the Customer Support Center.

Agent/Customer Support Center is very important to EWD. We need the full services, help and advice of our Agent/Customer Support Center. The Agent/Customer Support Center commissions are assured and factored in all EWD deal finalization prices.  The Agent/Customer Support Center will be kept in the loop of all correspondence, negotiations and meetings and his full help & support is needed for successfully closing each deal.

All payments from buyers or clients for our business and properties must be made in the name of EAST WEST DEVELOPMENTS only,  and paid to our Paypal account via the reservation forms page. http://www.eastwestdevelopments.com/reserve.html    The Agent/Customer Support Center may not accept payments directly in his name or in his company name for our properties and business deals. The Agent/Customer Support Center has no authority, without written permission to enter into Agreements or legal commitments on behalf of the EWD directly with any client or parties.  

Reporting:  The developer undertakes to keep the Agent/Customer Support Center in the email correspondence loop of all correspondence with customers, and to report to the Agent/Customer Support Center the progress of each lead supplied as it progresses.

Payments:  The commissions are paid to the Agent/Customer Support Center  within 15 days of the Transaction date.  In case of delay a Late charge at the rate of 10% per annum will be paid by EWD, calculated from the due date till the payment date.

Commissions adjustment in case of Cancellations & Refunds:  Sometimes the Sale/Purchase is cancelled and the money is refunded back. If that sale is thru an Agent/Customer Support Center.  Then the Agent commissions on that particular deal are also cancelled, and the Agent/Customer Support Center will  refund back to the EWD or to his client any commissions received in that respect.  It is projected that such refunds and cancellations are likely to be less than 1-2%.

Promotion:  For promoting and selling the developer properties and business, the Agent/Customer Support Center will have to do so at its own costs, and will need to find his customer base himself. All our properties and business sale info is on the website. The best for the Agent/Customer Support Center would be to copy and paste or print the key pages, study all the info, get any clarifications if needed and then start and promote to his friends, customers,  and client base or by developing his own web site. Agent/Customer Support Center may use any marketing methods, such as Advertising, Board, Display, Booths at Property shows, Thru the Internet, Listing on Property websites, blogs, twitter, facebook, social websites, Chatting, sending emails etc. Commission earnings of over US$ One million per year are achievable.  EWD can also teach the Agent to easily bring in good results.  The Agent/Customer Support Center will market the properties professionally at all times and will notify EWD of any advance changes applicable to the sale.

Duration of the contract: The present contract will be effective from the date of signature to this agreement and shall have a duration of 1 year and will be automatically renewable  every year, save where the parties to the contract agree to terminate the same with mutual consent. However any party can cancel and terminate this agreement anytime by giving a 7-day�s notice to the other party. This Agreement Renewable will be as per the latest Agent/Customer Support Center form (this form) published on our website.

Termination:  If the Agent/Customer Support Center becomes inactive and does not correspond or present or forwards any new business or leads to EWD for a  period of 12 months, then this Agreement is automatically terminated. The Agent is considered dead for business. After the termination or expiry of this Agreement, the Agent will not receive any commission on any new funds received from the Agent/Customer Support Center existing clients and  customers. The Agent/Customer Support Center only gets commission on funds received from customers before the termination or expiry date. The Agent/Customer Support Center however, will retain and keep all commissions already paid to him till that date.   On termination, the Agent/Customer Support Center will return or delete from his computers all the intellectual property info, email addresses of clients, contacts info, correspondence etc, and not use or sell or give this info to a third party.

Performance:  We are looking for a long-term relationship. When our customers call or meet you, and if you are unable to satisfy them or, if your handling of the Customer Support Center is poor or not  professional, or if  we get complaints from our Investors/customers, then EWD may cancel or downgrade the Center to the level of an Agency.

Guaranteed minimum monthly advance payments: However if your performance is good, then we can talk with you on giving you a minimum guaranteed advance payments of upto $5,000 monthly to start after your handling of 50 clients per month satisfactorily. EWD has to be sure you can perform.

Business volume: Initially, we expect 1-2 Overseas clients per month visiting the Customer Support Center. And perhaps 2-3 phone calls per month.  However this is likely to increase. These clients, contacting the Customer Support Center are highly  motivated, informed and involved with our projects.

Confidentiality:  The terms of this agreement, and the details of the properties offered are confidential between the parties and neither of the contracting parties may divulge the contents without consent in writing to any other party.

Both parties agree to be bound by all the above terms and conditions on the date.

 On approval EWD will send an Approval confirmation email to the Customer Support Center. Properties under the jurisdiction of this Support Center will be mentioned in the Developers approval confirmation email. The Customer Support Center is eligible to commissions, only after the approval, and confirmation by EWD.  EWD reserves the rights to reject any Customer Support Center form or application. Approval will be binding between the two parties.
